This branch examines what the courts actually decided, what evidence was before them, what was not decided, and which alleged errors remain questions for documentary review.

BP Properties Ltd v Buckler

The Wiki records the 1986 High Court decision and the 1987 Court of Appeal decision as possession/limitation litigation. The appeal page records the court’s reliance on the 1974 licence letters and its statement that the family’s claimed title documents were not produced.

The scrutiny question is whether later readers have mistakenly treated the possession decision as a complete determination of the documentary root of the farmhouse parcel. The Wiki does not do so.

Judicial issues recorded for review

  • the treatment of the two parcels as one in parts of the litigation narrative;
  • the distinction between adverse possession, permissive occupation and documentary title;
  • the effect of the 1962 possession order and the 1974 licence correspondence;
  • the absence, at the appeal, of the family’s claimed title documents;
  • the title-register state during the 1986–87 litigation.

These are review questions, not a declaration that any judge acted unlawfully or that a miscarriage of justice has been legally established.
