Marquess of Bute v Seymour; Marquess of Bute v White; Barry Railway Co v Seymour; Barry Railway Co v White (Llandough right of way, 1905)
Why it is not ours: Bute land on the Cornerswell side of the parish; no Williams and no Great House appears in any report.
The record
- The court's view: “Mr. Justice Lawrence, sitting in the Nisi Prius Court, Cardiff, formally entered judgment for plaintiffs in the Llandough right of way dispute case, and granted an injunction in the terms asked for—restraining trespassing on the land of the Barry Railway Company and also of the Marquess of Bute, with costs.” (Evening Express, 29 Mar 1905, p.3). The special jury's verdict for the plaintiffs came on 28 Mar 1905 (Glamorgan Assizes, before Lawrence J).
- The action: “they each sued each of the two defendants … for damage for trespass on June 4, 1904. The defence was that the defendants were legitimately using a public path across fields at Llandough, the property of the Marques of Bute, and across the Barry Company's line, and leading from the Cardiff and Sully road to Eastbrook.” (Evening Express, 20 Mar 1905, p.3).
- Counsel for Bute (a submission, not a finding): “Between the years 1848 and 1893 there was no person who could dedicate, because the estate was in strict settlement” (Evening Express, 28 Mar 1905).
- Costs “including the expense of the assize action and the previous proceedings in London” were about £2,000; the defendants' share, about £500, was raised by public subscription (Evening Express, 31 Mar 1905, p.3).
- The land named: the Green Seys (“Greensays”) fields, Cornerswell Farm, Westhouse, the One Acre Field (“Erw Heol Goch”) and a field of Colonel Homfray's.
What it does and does not establish
The same parish and the same landlord, Bute, but different land towards Dinas Powis. About twenty reports were read; none names Great House, Tŷ Mawr or the Williamses. Bute acting as owner of Llandough land in 1904–05 fits the Williamses being Bute's tenants.
Next step
Only if family papers mention a path or trespass case: the Bute estate's own file (solicitor J. S. Corbett) in the Bute papers at Glamorgan Archives.
