MR-0064 Catalogued, Not Yet Viewed

Deposited plans and books of reference for the railway and waterworks schemes over Llandough, 1876-1901: owner, lessee and occupier of each plot

Required by Parliament's standing orders; catalogued, not yet viewed.

Why: Practice required by Parliament's standing orders for private Bills (deposit of plans, sections and books of reference; Gazette notice; list of owners, lessees and occupiers) + statute (Lands Clauses Consolidation Act 1845, incorporated in the Bills) + cross-reference (London Gazette issues 25417 p.5380, 26460 p.6693, 26797 p.6654, 27380 p.8304; The National Archives catalogue entries for the Parliament Office deposited-plan series).

Every private Bill seeking compulsory powers over land had to deposit, before the session, a plan of the lands and a book of reference naming the owner, lessee and occupier of every numbered plot, with Parliament and with the clerk of the peace of the county; the Gazette notice and a list of owners, lessees and occupiers (showing who assented, dissented or stayed neutral) followed. Notices in the London Gazette show at least four schemes with powers over land in Llandough-juxta-Cardiff: the Penarth Extension Railway (1876); the Barry Dock and Railways Company's Railway No.1, ending in Llandough by a junction with the Penarth Extension, with the Lands Clauses Acts incorporated (notice of 25 November 1884); Cardiff Corporation's waterworks conduit from the Cogan reservoir, ending in Llandough (notice of 21 November 1893); and the Taff Vale Railway's Bill of 1896 for compulsory purchase of lands in Llandough east of the Penarth branch near Llandough Lower Junction, whose 1897 Act authorised compulsory purchase of plots numbered 13-18, 21 and 22 on the deposited plans in that parish, with time extended in 1900 and again sought in 1901. The books of reference for these schemes should therefore name, plot by plot, who was treated as owner and who as occupier of every piece of land the schemes touched in the parish, from a source outside the estate's own papers. Against: a book of reference records the owner of record and the occupier as the promoters found them, so for land of the Bute estate it would be expected to show the estate as owner and any farmer as occupier; deposited-plan numbers are not tithe numbers, and whether any listed plot lies within the holding is not checked; a scheme deposited is not a scheme built, and land named in a book of reference was not always taken. Parcel not identified (the holding's c.1841 plots lie within tithe 196-267 and 275-281; the deposited plan for each scheme would show whether any of its plots fall within them).

Who should hold it: Parliamentary Archives deposited plans, catalogued in The National Archives' Discovery: YHL/PO/PB/3/plan1876/P4 (Penarth Extension Railway), YHL/PO/PB/3/plan1885/B4 and plan1884/B5 (Barry Dock and Railways; which file carries Railway No.1 not checked), YHL/PO/PB/3/plan1897/T1, plan1900/T5 and plan1901/T2 (Taff Vale Railway); House of Commons copies under YHC/CL/PB/6. No catalogue entry located for the 1893 Cardiff Corporation waterworks deposit. The county deposits with the clerk of the peace (Glamorgan Quarter Sessions): whether held at Glamorgan Archives not checked.
