MR-0068 Not Yet Searched

Mountjoy Ltd's surviving title papers in the Crown's 2011 bona vacantia file (T S ref BV21111179), including its 25 December 1938 conveyance

Required by practice once the land vested in the Crown; not yet searched.

Why: Cross-reference (London Gazette 59962, 9 Nov 2011, notices L-59962-1473802 and -1473803); practice (a disclaimer of unregistered land identifies the deed under which it was held).

Mountjoy Limited, the Bute estate company that was party to the sale to Western Ground Rents on 25 December 1938, was itself a purchaser by a conveyance of the same date (land at Cwmbargoed, Merthyr Tydfil). That land stayed unregistered in its name, passed to the Crown when the company was dissolved, and was disclaimed by the Treasury Solicitor in 2011. To disclaim unregistered land the Crown's lawyers had to identify the deed it was held under, so the file should hold or cite the 1938 conveyance, and may show whether the Mountjoy purchase and the WGR sale were one multi-party instrument with a single schedule. The WGR conveyance itself is not held (see the 1938 conveyance item). Against: the Cwmbargoed land is not Llandough land; an earlier check found no Llandough land in the 2011 notices; and the file may hold only a copy of the Gazette notice and a land search.

Who should hold it: Government Legal Department (Bona Vacantia), and the Crown Estate for land disclaimed after 2011. A records request to the Crown Estate is drafted, not sent.

Date of the record: 1938-12-25 / 2011
