About What the courts said, as they said it.

What the courts said, as they said it. The Court of Appeal in BP Properties Ltd v Buckler [1987] EWCA Civ 2 recites a High Court possession order under Order 14 (2 February to 4 July 1955), a Cardiff County Court possession order of 11 December 1962, and the judgment of Hollis J in the Queen’s Bench Division at Cardiff on 24 July 1986. The European Commission of Human Rights, in its decision on admissibility, records the writ for possession of 22 May 1984.

“I can see no escape therefore from the conclusion that, whether she liked it or not, from the time of her receipt of the letters, Mrs Buckler was in possession of the farmhouse and garden by the licence of BP Properties Ltd, and her possession was no longer adverse within the meaning of section 10 of the 1939 Act. Accordingly I would dismiss this appeal.”
