Whyte & Co. Ltd v Cardiff Corporation (Western Sewer contract arbitration, 1910–1912)
Why it is not ours: A contractor's money dispute with Cardiff Corporation, not a title or tenant case; it names no farm.
The record
- The arbitrator's view: Mr H. Percy Boulnois, M.Inst.C.E., “has given his award in the case of Whyte & Co., Ltd., v. Cardiff Corporation, in respect of a dispute which arose between the parties after the completion of the western [outfall sewer]” (Dublin Builder, 25 May 1912, p.28; snippet). The hearing ended at the Westminster Palace Hotel, London (Western Mail, 7 Mar 1912, p.5; snippet). The amount of the award has not been read (paywalled); the South Wales Weekly Argus of 11 May 1912 headed it “CARDIFF'S SURPRISE. Summary of the Award”.
- The contract: Whyte & Co. of Belfast took Contract No. 6, Western Sewer, at £70,368 5s 4d (Evening Express, 11 Jun 1906).
- The dispute: a final account of £123,452 3s 10d, “the difference of £53,083 16s. 6d. really represented extras”; the town clerk was asked “to advise the committee upon the legal questions involved” (Evening Express, 14 Jul 1910).
- Afterwards a council row: Western Mail 24 Oct 1912 p.6; Western Mail 15 Jan 1913; South Wales Daily News 19 Feb 1913 p.6, “Cardiff Western Sewer. ‘NOTHING TO HIDE’” (snippets).
What it does and does not establish
The only dispute found that arose from the works the 23 Feb 1905 Bute conveyance to Cardiff served (EV-0013). It is a contract arbitration, not a court judgment, and nothing read shows it went on to the High Court. Whether Contract No. 6 was the Llandough section is not known.
