Dillon LJ, giving judgment:

“This appeal, by the defendant in the action against a decision of Hollis J given on July 24 1986 when he was sitting as a judge of the Queen's Bench Division in Cardiff, raises a novel question of some potential importance under the provisions of the Limitation Acts 1939 and 1980 in relation to the acquisition of title to land by adverse possession.”

“I can see no escape therefore from the conclusion that, whether she liked it or not, from the time of her receipt of the letters, Mrs Buckler was in possession of the farmhouse and garden by the licence of BP Properties Ltd, and her possession was no longer adverse within the meaning of section 10 of the 1939 Act. Accordingly I would dismiss this appeal.”
